Hi Im having all kinds of problems, I and my partner received the migration letter. We were both in the support group. They are saying that my partner is confirmed as being in that group, but I do not have a WCA decision on my claim. They have even asked for a fit note.
Please can someone direct me I am so confused right now. There was no review under way before the migration. How could they be paying me money if there isn't a decision on my claim and why didn't I know about it?

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi BlueAngel
When you were on ESA did you have individual claims or did you have a couples claim? I only ask because I know of someone else having the same difficulty and although they are both disabled they lumped the two together, though evidence was only ever submitted for the husband and she was added as an after thought. You need to raise this issue through your journal.

Ok I messaged them we were originally separate then put together as a joint claim. I on ESA receive the carers element to help my partner, we both received full pip and the sdp. We received a letter saying that we were no longer entitled to the ADP element. Is this because the move to UC? It's so confusing

Hi BlueAngel
You can only get one LCWRA element in a joint claim, what you should also get as your partners carer is a carer element.
There are no disability premiums when you claim UC, most claimants in receipt of SDP are worse off claiming UC which is why the Government brought in transitional protection.
We would advise you to seek advice from your local Welfare Rights Organisation: advicelocal.uk

Just wondering when I look at my payment page on UC. It says we pay our own rent, but it was housing benefit and I had to pay extra for the extra bedroom we have.
Also when I filled the form in, I got confused with the caring questions, I said yes to caring 35 hours or more for my partner and vice versa because we are with each other 24/7 On my partner's ESA letter dated April this year, sdp, severe disablement and carers element for me caring for him and support group, then my own letter stating support group esa, my question is it says we are caring for 'someone' and receipt of carers allowance, the amount is standard, our savings will mean we don't get the transitional payment, does this all seem typical? They said my partner has never had carers allowance and they recognised it in the journal, but unchanged on the payment page. There was a journal entry asking me to contact carers allowance and end it because it was suspended. I originally was a carer for my son who now lives in assisted living. They have said I should go to change of circumstances for the caring part though I said it was a genuine mistake. I didn't read it properly or think about it and once it's submitted you can't do anything about it. Any thoughts or help would be appreciated, really didn't want to have to get welfare rights involved if I could sort this mess out.

Hi BlueAngel
I know where you are coming from but sometimes you do need help from an experienced adviser.
With UC for those who are working, there is a work allowance which comes in two components, high and low, for those claimants not claiming any housing cost element (HCE) they get the high rate of £684, for claimants claiming housing cost element such as rent they get the low rate of £411.
Part of your post does not make sense where you mention yes to caring 35 hours or more for my partner and vice versa, this is why you need to get help from your local Welfare Rights Organisation.
