Severe disability payment and IS10 form was created by Holysmoke
Hello,

I received an IS10 form back in March and duly returned completed immediately.
Having received nothing from DWP as acknowledgement, I telephoned them to check the form was received. This was confirmed as received.

I have looked at google to see current waiting times and see that 6 days is considered processing time on receipt of form.

May I ask how much longer I should expect to wait for a reply or payment please?

I am on IR ESA, PIP.
My husband is retired on state pension and in receipt of AA. No carers allowance claimed.

Hi Holysmoke

I expect they are checking the Mixed Aged Couple rules. But as you are the main claimant for ESA then you should qualify. You could phone the ESA section and see if you can get a reason for the delay.

Thank you David.
The DWP sent me the is10 out of the blue. (Possibly as they have realised I am one of those they had been missing paying).

When I checked my award letters since 2013, I notice I hadn’t received the DP.
It was only last year when my husband claimed AA so I presume it was at that point we became entitled to severe DP?

Hi Holysmoke

You are correct, The severe disability premium (SDP{) can be awarded in addition to any other premium that may be payable. It is £82.90 a week for each person who qualifies. To qualify:

~ You must receive a ‘qualifying disability benefit’.

~ no one gets a ‘qualifying carer benefit’ for looking after you. These are:
~ Carer’s allowance;
~ carer support payment; or
~ the Universal credit carer amount; and

~ you technically count as living alone

If you both get a qualifying disability benefit and no one gets a qualifying carer benefit for looking after either you or your partner, your SDP will be £165.80.

Just a quick update.

I received a call yesterday from a DWP worker who confirmed I was due a back dated payment for SDP.

Since receipt of completing the form, some 13/14 weeks has passed before they finally got round to my form.
The backdated amount covers from March 2024 to date and totalled in excess of £8k, so a nice call to take.

However, I have claimed JSA/ESA since 2013 and DLA/PIP too receiving the higher level for both components. My question is as follows: when I raised previous years may also need reviewing, the person said after a quick glance, oh no, you won’t be entitled to disability allowance before because you weren’t on Income related ESA. Actually, between 2013 and 2024 my husband worked for approx 2 years of that period, so I understand I wasn’t on IR. However, there were certain times when we were on IR EESA. Should I write to them to ask for a Mandatory reconsideration or would they have looked back at the whole period I have been on benefits? Thank you.

Hi Holysmoke

It is not that straight forward, you have to take into account my previous post.

I would seek advice from your local Welfare Rights Organisation before you ask for an "any time review" they will be able to take all your circumstances into consideration.
