ESA mixed age couples clerical was created by kimclifton@ntlworld.com
I was in a mixed age couples clerical claim for ESA with my husband. He started to receive state pension in 2020 and we still received ESA due to both receiving the severe disability premium.
My husband passed away in February, I was still under the impression that I would receive ESA. I received a letter from ESA on the 14th March but dated the 3rd March stating that my husbands claim for ESA has now been closed due to his passing and told to claim UC. Unfortunately at this point I didn't know if I was coming or going as I was and still grieving the loss of my husband of 50 years. I eventually claimed UC and this has also been a total nightmare. This month I was left with £142.13 then I had to take out part of my rent of £92.03 which left me just over £49 for the remainder of the month. They then said that they owed me money but this has been going on for different things that they dont even know. I was paid £304.08 yesterday which of course helped a great deal. I also have just started receiving CA as I help my daughter. Without this money I would have been left without food. I dont understand why I was told to go over to UC without being migrated over.

I'm sorry to hear about your husband. From what you've said you were understandably not in a fit state to deal with the DWP. You say that you claimed UC and it sounds like you mae the decision to do this. (Sorry if I'm incorrect). You would not have been migrated across because when your husband died they would not have split your claim without you contacting them - so it seems they just closed it.

You may want to contact a local advice agency such as CAB, Welfare Rights or Age UK for advice as this is complex query. An adviser may be able to untangle the situation. make sure that you are receiving the right amount of UC and if DWP provided incorrect advice. help you to make a complaint if you want to.

Hi Kim
Follow BIS advice and change you user name as you leave yourself open to scams.
In case you are not aware your email address is showing as your user name and can leave you open to unwanted emails, we would advise you to change your user name, if you want to change this then follow the instructions in the following FAQ
www.benefitsandwork.co.uk/guides-for-claimants/faq/forum
Have you been in contact with the bereavement service helpline; 0800 151 2012, you may be entitled to a bereavement support payment ~ www.gov.uk/bereavement-support-payment/how-to-claim.
Unfortunately what you have been told I believe is correct as your husband was the main claimant. You can not migrate over unless you receive a letter inviting you to claim UC. We would advise you to see help from your local Welfare Rights Organisation: advicelocal.uk
