I'm appointee for my daughter, she has migrated from Income support to UC. Her income support was worked out as follows:
£90. 50 allowance for her £42.50 as sick or disabled, £81.50 as severely disabled, £45.60 as she is a carer for her son and £20.85 disability income guarantee. toral weekly amount £280.95. She has enhanced PIP for both mobility and daily living and is on a light touch award.
She has received her UC and has an APA for her rent and 2 weekly payments, broke down as follows: standard allowance of £400.14, her rent is £511.16 but as she has a spare bedroom it is reduced to £405.78, £201.68 as she is a carer for her son and a transitional protection of £729.44. Total UC £1737.04 monthly. They then minus her carer allowance of £360.97 advance of £41.68, and £405.78 to landlord leaves her £808.43 a month.
Her son who she cares for, as in staying with him 24 hrs a day due to his severe mental health has addiction and is soon to go into rehab, she will then lose her transitional protection. She herself has mental health issues, depression anxiety, she has learning problems so does not read and write, went to special school, has epilepsy.
My query is this, I think she should be in the LCWRA group as when he moves into rehab she will lose her transitional payment and also have 2 spare bedrooms. Should I request a form for LCWRA now as that is basically where she was on income support prior to being her sons carer, she has never worked due to her disabilites which can be verified by her light touch PIP award

Hi anneisit
As Appointee you will have to report a health condition on her UC account and then get a Fit Note from her GP or other clinician. You will need to have Fit Notes until she has had her WCA decision. If the WCA goes in her favour then she will get the LCWRA payment. Hopefully she will get a paper based decision as usually where the DWP grant an appointeeship it is an indication that the claimant is not going to be a great help to an employer.

Thank you but surely as she was in receipt of she was previously in receipt of £42.50 as sick or disabled, £81.50 as severely disabled and £20.85 disability income guarantee. She is on light touch PIP award, she should have automatically been placed in that group?

David is correct, when you daughter migrated from IS to UC, as she was in receipt of CA she would not have been eligible to claim LCWRA and therefore there would have been a break in her claim.
As there is a break in her claim she will need to hand in fit notes until she is told by her work coach they are no longer required, this starts the assessment period which lasts for 13 weeks, she will be sent a UC50 form to complete.
I would advise you to seek help from your local Welfare Rights Organisation: advicelocal.uk
