Discrimination against Contribution Based ESA claimants when migrating to UC was created by Anna
I haven't seen anything about this in any of the newsletters or worksheets, so thought I would raise it here.
Has anyone who was previously claiming ESA (that was Contribution Based with an Income Related top up) noticed that you lose money when migrating to Universal Credit?
Technically you aren't losing money from your actual claim, but the 2 week run on payment.
Those on IR ESA will receive the full 2 weeks run on, and then receive their full first UC payment once due.
Those with CB + IR ESA mixed claims however, will technically only receive the top up portion as a run on payment, as the CB portion (which is the majority of the run on payment) will be treated as income and deducted from the first UC payment.
I wanted to know if anyone else has come across this, and whether anyone has successfully appealed this and won. CPAG have published an article on it, but I can't find anything else anywhere!
Might this be worth a newsletter post also?

It maybe because it is possible to be a wealthy person with a large amount of savings and still receive Contributions Based ESA.

I recently completed migration to UC and unknowingly was receiving CB ESA which is now New Style ESA
I made UC claim on same day as i received ESA.
2 weeks later i received full ESA run on payment less 1 day.
2 weeks after this i received first New Style ESA payment of £281.10 and have continued to receive this every fortnight.
My current UC payment and NS ESA payment combined are exact total i was receiving prior to migration.
(Total includes LCWRA and TP).

The deduction I was referring to is from the run on payment.
Your first UC payment had a deduction for a full month of ESA (£609.05) instead of a deduction for the first actual payment of £281.10.
So your run on payment was actually deducted (minus the IR top up/premiums).
People who are in receipt of the exact amount of benefit but with no CB entitlement, received no deductions from their first UC payment, effectively getting £281.10 bonus that those on CB related do not receive.

This still feels like a poor excuse, especially when anyone migrating from ESA must also have an IR top up, and therefore are subject to the same capital/savings rules as IR ESA.

Same here, apart from they deducted £14.88 off me saying that it was for ESA that i was not entitled to.
