Migrating from ESA to UC now received an appointment to discuss ESA at Job Centr was created by Steve163
Hello,
I'm currently migrating from irESA to UC, I have just now received an appointment to "discuss my ESA claim at a Job Centre" next month.
This has caught me off guard and I'm wondering if the Jobcentre are breaking the law, as I filled in the following template in my journal on the 15/5/25, as advised by Benefits & Work;
"Please be aware that I am migrating from ESA and that I am therefore not required to provide fit
notes or undergo a WCA. Instead, the law requires that my WCA status for ESA must be
automatically transferred to my UC claim.
For further details, please see Regulation 19 of The Universal Credit (Transitional Provisions)
Regulations 2014; Regulations 39 and 40 of the Universal Credit Regulations 2013; the Advice
Guide for Decision Makers, Chapter M6: Effects of transition to UC".
Any replies or advice on this matter would be most appreciated, because to my knowledge there shouldn't be an "appointment" to discuss why or with what I'm sick? I'm sure even the Citizens Advice Bureau advise this. Is this a WCA hidden as an appointment?
I am a carer for my 100 year old mother and have a balance condition that finished my electrical career. I also have Panic Disorder with Agoraphobia and proof of the diagnosis from a Psychiatrist.
Again any replies/advice to this latest bit of news would be gratefully appreciated.
Best wishes,
Kieron N.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Steve163
I expect its for your New Style ESA Claimant Commitment but it can be done over the phone. So send a UC Journal message to The Work Coach stating --
I am a carer for my 100 year old mother and have a balance condition that finished my electrical career. I also have Panic Disorder with Agoraphobia and proof of the diagnosis from a psychiatrist.--
Also say that as a Support Group claimant I am part of the DWP Enhanced Support Journey and do not have to commute to the Jobcentre.
You can say in addition that unless reasonable adjustments are made you will complain to the Jobcentre Area District Manager.
Let me know how you get on.
