Hi.
Ongoing issues with adjourned hearings but might as well push on strengthening my case.
My assesment was due to be by video link - it never connected so the call was by telephone. However the assessor stated it did. I raised this in my statement to tribunal stating I did not recall any video link.
Having taken the opportunity to evaluate my PIP report inconsistencies are apparent.
Based on the analysis I have thrown together below how do a Tribunal Panel view directly calling out an assessor?
PIP Report Issue: The PIP report contradicts itself regarding my appearance during the assessment. It states, “X joined the link and passed security questions, he appeared to be wearing night wear” (PIP, Page 7), suggesting I was in pyjamas. However, in the Mental State section, it claims I was “Well kempt. Casually dressed. Looked well” (PIP, Page 8), implying a more presentable appearance. These descriptions are inconsistent, as being in “night wear” (pyjamas) does not align with being “casually dressed” and “well kempt.”
Support for No Video Link: I confirm the assessment was conducted entirely by phone, with no video link established, as the connection failed. The contradictory descriptions of my appearance (pyjamas vs. casually dressed) support my recollection that no visual observations were possible, as the assessor could not have seen me. The report’s claim of visual data (e.g., “adequate rapport and eye contact,” “did not look tired,” Page 8) is therefore unreliable, as no video feed was available to assess my appearance or demeanor.
Inadequacy: This contradiction undermines the report’s credibility, particularly for assessing personal care activities like Dressing and Undressing (Activity 6, Page 14) and Washing and Bathing (Activity 4, Page 12). The report acknowledges I stay in pyjamas on bad days and change clothes every few days (PIP, Page 5), yet uses the “casually dressed” observation to justify descriptor 6a (0 points) - can dress and undress unaided (PIP, Page 14), ignoring my reported difficulties due to fatigue and depression. The invalid visual observations inflate my functional ability, failing to account for the reliability criteria.

I would be arguing with those sorts of contradictions that the assessor appears to have been talking about an entirely different claimant (which has happened to some people), when every aspect of your appearance was factually incorrect. If no video link was established, the assessor never saw you and therefore could not comment on your appearance or supposed ability to maintain eye contact or judge whether you were tired.
(If there had been even a momentary video link, you would have been able to see the assessor) and you need to say that. I would call out the assessor for a sloppy report that doesn't meet professional standards. Don't be tempted to call the assessor a liar.
However, when it comes to the dressing and undressing push on your difficulties - not on the assessor's contradictions at this point - because you need to show them that your condition either means that you need help, or you aren't able to do it because you have no help. Her being wrong about what you were or were not wearing on that day will make no difference to any new score.

Thank you. I previously stated in my statement as evidence that I believed the assessor must have confused me with another report as to the video link!
I have basically had my assessors report broken down and cross referenced with LCWRA, my personal statement to tribunal and NG206 guidance and highlighted every aspect that is either contradictory in the assessors report itself (a lot!)or with other evidence.
Due to the second Tribunal delay I will upload this as further evidence then give the DWP a call specifically asking for them to look again at my case.
Re. DWP two calls on Friday waiting for 50 minutes+, two conversations with agents who said I would br transferred to a case manager and two disconnections.
I think I will be asking for whatever noted they have of the conversations because on the second I specifically requested they call Mr back if I was once again disconnected.
