Hi again, so our ( me and wife’s) managed migration from income related ESA to UC has begun. So far ,so good. We have managed to get verified .Me via the phone ,her via a visit to the job centre. We have been given a date for our first payment.
The system seems to have recognised that i have severe health problems as my ‘work Plan’ says that i am NOT required to look for work or take part in other activities..
Now, my wife has been working part time for many years and was allowed to work up to 24 hours a week under the ESA rules.
She continues to work now but it seems she will have to work MORE hours to reach the earnings threshold . Problem is that her own health is failing fast .She can handle working around 15 to 20 hours per week but is in terrible pain all day and has walking problems etc . She WANTS to keep working around 15 to 20 hours a week but is fearful she is going to be forced to do more .
She has been referred for medical tests .
Is there a way she can continue to work those 15 to 20 hours a week without being punished by DWP and made to chase around looking for more work ? She can’t stand for long , can’t sit for long and gets exhausted very quickly .We are both almost 60 years old . Her current job is perfect for her as it is close to home and her duties are fairly light. She simply could not handle more hours .
Is there a way around this ?
She is NOT my paid carer and does NOT wish to be but does obviously help to look after me during the night etc. as I am on enhanced PIP for both components.
Is there anything we can do ? Sorry this is so convoluted and long winded !

Hi David , well she is my unpaid carer overnight every night and at weekends..

I'm just looking back at your previous posts. I replied before that she will get her Expected Hours of Work reduced by the number of hours that she cares for you.

Assuming that no-one gets Carer's Allowance for looking after you, and if your wife provides care for at least 35 hours a week then she could inform UC that she is your carer. This would be beneficial to both of you.
1. She won't have any work requirements attached to her UC claim, so can continue to work at the hours she currently does.
2. your UC claim will include a Carer's Element of £201.68. This will be paid in addition to the Limited Capacity for Work and Work Related Activity (LCWRA) element that you will get, assuming you were in the Support Group of ESA.
She doesn't have to be a paid carer. She just needs to provide care for 35 hours a week. She wouldn't qualify for Carer's Allowance due to her wages, but she would qualify for the Carer's Element paid with UC. She will need to report a change on her UC account.
