hi, I have received Contribution and income related ESA since 2011, I am moving house next month will this trigger me to be switched to UC? will I still be classed as a legacy claimant, or will I lose that protection, I am reaching Pension age next February. Thanks

no I don't receive any housing benefits or any help with rent as my husband is working

yes he would agree do they take his wages into account or do I still get my legacy benefit?

It depends if you are moving local authority areas, if you stay within the same local authority area then everything should stay the same for the time being, claimants in receipt of legacy benefits will be receiving a letter from DWP inviting them to apply for UC.
Your post is slightly confusing as you state you get IR ESA, CB ESA and partner is working, your partners income would be taken into consideration with your IR ESA claim, under UC if you are in receipt of ESA support then you should be placed in the LCWRA group, this would entitle you to get the high rate Work allowance as you do not claim rent. We would advise you to seek help from your local Welfare Rights Organisation; advicelocal.uk, where they can take all your circumstances into consideration when giving advice.
