Phone call from PIP and tribunal was created by JLP
I had an unexpected phone call from the dwp today checking on some information for my tribunal. A few hours later I get a text off the tribunal service that says “the DWP have responded to you appeal they should have sent you a copy in the post…….read their response and send any comments to the tribunal” what does that mean?

Hi JLP,
I believe this is just an update to inform you that the appeal bundle is on its way. You would have got this text because you signed up for updates when you lodged the appeal?
Once you lodge the appeal either online or using a paper form sent in, after around 4 to 6 weeks DWP has a duty to prepare an appeal bundle. This is all the claim forms, assessment report, medical evidence you sent it and copies of decisions and the appeal form. The tribunal get a copy too.
Once you get a copy have a read. If you wish you can send in legal arguments (submission) further explaining why DWP got their decision wrong and why you should be awarded PIP. You don't need to do this, and if you have already done a full argument when you lodged the appeal you probably don't need to. It could be important to do this if you haven't already criticised the assessment report.
Try and work out 4 or 5 bullet points to explain the major criticisms. Give examples. Try not to nit pick, but fir example if the report is poorly written, confusing or ambiguous, with grammatical errors this could all be placed within one bullet point and will reinforce that the report was full of errors, and generally lacking in correct detail etc.
The letter with the bundle may say that you should send in any additional evidence or a submission within 2 weeks. Dint worry about this, as long as you send stuff in within 2 weeks of the hearing date you'll be fine.
