Thanks for your kind advice.
I wrote the following:
Attention of Barbara Billings, District Manager
Dear Ms Billings,
I am writing to complain about my treatment thus far in the migration process from ESA to Universal Credit.
I completed my Migration form as requested and also proved my identity with passport, driving licence, etc using the chip in my passport.
I was then asked to attend a telephone Biograhical meeting.
I was sat ready by my phone and had all the paperwork ready. This was cancelled without any notice. I called the DWP to ask why no one called me. They could not see a note on the system to say why it was cancelled.
Due to my Autism and other disabilities I cannot cope with change easily, and less so without any notice.
When I did have my Biographical meeting with Jackie I was again asked to provide proof, evidence, etc by attending a Job Centre in person (which I am unable to do) to provide information I have provided already several times over,
I was then asked if someone could do it for me, which suggested my main carer may be able to do. However, I pay my carer to do jobs for me and I am on low income, besides which why do they need to bring proof to the job centre of information I have already provided.
I will be using the same bank account I have been using for several years to receive my ESA payments.
Further to this, I was then asked to provide a Fit Note. During completion of my Migration Form I was told I do not need a Fit Note.
I then sought legal advice on this, and was informed to write the following:
Please be aware that I am migrating from ESA and that I am therefore not required to provide fit notes or undergo a WCA. Instead, the law requires that my WCA status for ESA must be
automatically transferred to my UC claim.
For further details, please see Regulation 19 of The Universal Credit (Transitional Provisions) Regulations 2014; Regulations 39 and 40 of the Universal Credit Regulations 2013; the Advice
Guide for Decision Makers, Chapter M6: Effects of transition to UC.
In addition, as I am in the support group on ESA, I should be automatically transferred to receiving the LCWRA element on UC and will therefore have no work-related requirements. This means I will not have to see a work coach or carry out any tasks or activities to receive my UC.
Would you please confirm that I dont have to attend a Job Centre to proof any documentation, as this has already been provided. In addition, will you confirm DWP has sufficient information to process my ESA to UC Migration and will process my application without further delay.
