I would be grateful if you could advise. I am in process of starting probate for my nan’s estate and she has left everything to me. I am currently on benefits and need to know do i let the DWP know now that I am about to start the process or do i let them know once the estate is settled. I am concerned that they will stop my benefits if i let them know now about the probate. Many thanks
As you are the executor it is possible for the DWP to claim that you are in possession of your legacy as soon as you receive the grant of probate. However in normal circumstances where the DWP does not think there has been prevarication the DWP will wait until the assets have been distributed and creditors settled before they investigate.
