hi!
my partner and I migrated to uc from tax credits in May of last year. things seemed to go okay. I receive pip (thank you baw! ) and I submitted information to begin my "health journey". my first uc50 form was filled in with welfare rights over the phone last June. she then sent it to me to check and add my prescriptions list. it was horribly filled in, as if she hadn't listened to me. I made amendments and then sent it in. they never received it. I did not receive the next posting of a uc50. then I did the next, but they didn't receive it (it took me longer than deadline - each retelling is traumatic, but they okayed the extension). twice more of that. I then got a notice that my health journey with uc had ended and I was deemed capable for work. I requested a mandatory reconsideration through the uc journal as was requested by them. it took six weeks. but the wording was weird. I was justified in having forms in late. they will send another uc50 for me to continue my health journey. then, the wca folks through the journal (before any form can have reached me) asked for me to send the uc50 form in. I don't have one here to fill out. I told them that, and that the decision contained provision for another form to be sent.
they've replied with, do you want another form to be sent out to you?
honestly? no. I've filled this out five times, including the one with welfare. I've asked if there's another way to continue the lcw/lcwra assessment, without directly answering the question.
is it time for actual legal assistance?
I haven't needed to be looking for work, but I think we haven't been paid fully this whole time (is that right? ), and the mental burden is crushing.
kind regards

Hi cdtyler

I'm sorry to hear of the position you find yourself in.

You can refuse to fill out another form, but unless they already hold a lot of information on you, you run the risk that your claim will simply be dismissed. You sound as if you have been unlucky with the post, but I would advise you to use a tracked post that the DWP have to sign for. Ignore the free post that is written on the envelope. It can be challenging to find the money for the postage, but it's even more costly if the post office keeps losing your form. You could ask them if you can just send them a statement, rather than filling out the entire form. Whether they will accept that, I don't know.

Even if you choose to get legal assistance - and we can't give you any advice on whom you may talk to if you wanted to go down that route - you still may not be able to avoid giving them some additional information.

I can't comment on whether you have been paid the right amount or not.
