Recent migration onto universal Credit - Do I have to provide new sick note?

Hello,

Can i ask for advice ,regarding a situation with a telephone call from my work coach. I have recently migrated from EsA to U/c ( in the making effort to find work but not obliged to accept group)-this will be my second month of u.c . During my phone call it was suggested I should be sorting out a sick note, I replied that I thought I was not obliged to do this as a migrated customer. She did seem to relent , however , am I within my rights or will they be able to force me to sort one out within a certain time period.

Appreciate any valid advice.

Hello Bri10,

You are correct in that you should not be being asked to provide a fit note if you have migrated from the ESA work-related activity group (as it sounds like you have) or the ESA support group. Your ESA group should migrate with you, so your work-related requirements would be those of 'Limited Capability for Work' (where you do work preparation but do not have to seek work) and there is no requirement for a fit note or work capability assessment.

This is also confirmed in Regulation 19 of the Universal Credit (Transitional Provisions) Regulations - in your case, Regulation 19(2) covers people migrating from the ESA WRAG group - see www.legislation.gov.uk/uksi/2014/1230/regulation/19

It's positive that your work coach relented but if the issue does keep coming up, you may wish to consider making a complaint about it.
