Hi,

Friend is migrating to UC from Income related ESA
She was on income support before that
Now DWP are saying they are on CB ESA too
Never qualified for CB benefits

Only worked for 6 months and 3 weeks over 30 years ago

This is causing huge stress

Hi Jamine19

Welcome to the forum.

You might want to have a look at the following FAQ which explains where everything is; www.benefitsandwork.co.uk/guides-for-claimants/faq/forum.

We cannot answer your question as we do not have enough information, your friend needs to visit their local Welfare Rights Organisation: advicelocal.uk where the cab take all their circumstances into consideration when giving advice.

This is a common error from the DWP . There is a lot of confusion about individuals being migrated from ir-ESA. Some should logically have their award replaced entirely by Universal Credit. However, from my own experience and the experiences of individuals migrating I know personally they end up having their award replaced by either;
1. UC
2. Contributions Based New Style ESA
3. A mixed award of CB- NSESA and UC
4. This is the worst - an award of CB-NSESA that is less than their legacy ESA award with no UC or TP to make up the difference. They then have to ask for a MR as they are worse off.
The DWP are still trying to fathom which group I fit into. There appears to be no clear guidance at the DWP. If there is the DWP are not following the guidance consistently.
