I finally got a date for my tribunal! Only took 16 months 🎉

The end of finally in sights, but I'm worried about the hearing, of course. Being as one of the conditions I claimed for is anxiety,it's not really a surprise...

Anyway, I have a few questions that I would like clarification on if possible.

My mum and my partner have both offered to come with me for support, can I take them both? My partner does most of the looking after me and helping me in my day to day life now, however my mum has seen 40+ years of how my life has been affected.

My claim is for ADHD, autism, depression and anxiety, and was originally made in December 2023. They can ask me all the questions they like but I'm still not going to remember exactly how my conditions affected me at that time, however I know that they are the worst they've ever been lately. How do I answer questions about 2023?

I am in the process of getting other comorbid illnesses diagnosed. How do I deal with that, if these conditions were present in December 2023, but I didn't realise these were part of my day to day life, as I just got on with having to be alive despite whatever issues I have. For example, the doctor is looking at fibromyalgia and)ME/CFS as I have been suffering joint pain and fatigue for a very long time. I just always thought I was tired and that was it. If I say the doctor suspects these conditions, will it be taken into account? All the disabilities in my original application can also cause pain and fatigue, so it's really difficult to separate what symptom is due to which condition.

I take medication for my ADHD, and it certainly makes me less tired, without them I can barely function at all. How does this reliance on medication affect how each of the descriptors apply (or applied at the time of application, prior to being medicated)?

I'm extremely anxious about the whole thing. I very much messed up my application as I was very sick at the time, as well as ADHD being undiagnosed and I didn't have anywhere near the understanding of how it so severely impacted every day of my life, however a year on from the diagnosis I have a much better idea of how I would answer each of the descriptors now. I worry that, in itself will lose my credibility, plus, we all know that the DWP hate if someone is able to speak with any level of intelligence.

Any advice would be very much appreciated.

Hi KatieE

1. You can take both your mum and your partner with you.

2. If you can't remember how your conditions affected you in 2023, then don't be afraid to say so. They will have some information from the form and what you said during the assessment.

3. The panel is trying to judge whether the 2023 judgment was fair. They won't consider any comorbidities that you are currently awaiting diagnosis for (as this information wasn't available to the assessor). You can certainly mention them, but don't be disappointed when they say they can't take it into account. That is the rule for everyone.

I cannot provide an answer about the medication, as such issues are specific to individuals. Their focus is on the PIP criteria and how you are able to do or not do the tasks laid out in each question.

Try not to worry about what the DWP thinks about your intelligence. It's very different with a Tribunal panel, who have medical expertise and a greater understanding of disabilities than the average assessor.

Thank you so much for your reply.

I think I'm mainly worried that because I have a clearer understanding of how certain things affect me day to day, I'm just worried they'll think I'm making it up as I was in burnout and couldn't understand what was happening to myself properly at the time, let alone articulate that to anyone else.

I'm glad I've finally got a date, at least the end is in sight, and although I will be exceptionally disappointed if it's not successful after so long, I'd be better placed to apply again.
