DLA to PIP migration - should instigate the move? was created by Alfeeee
My 29 year old son has been on DLA (middle care, lower mobility) for many years and has not been migrated yet to PIP. He has an indefinite award.
I’m concerned that any new PIP rules may end up with him getting a lower rate as it will be treated as a ‘new’ claim? Is that right?
Should I bite the bullet and start a new PIP claim now? I don’t really want all the hassle but if it is going to affect what he gets in future then that doesn’t seem fair when he’s already in DLA and they just haven’t moved him.
Advice?

Unless your son's health has deteriorated, they are not moving anyone from DLA to PIP at the moment. The last we heard is they should start again in 2028. This could change - and if it is Steve will report any changes in the newsletter.
Be aware, that many people on DLA had indefinite awards - but it means nothing when it comes to PIP - because it's a different benefit and only a very small number of people have indefinite awards. PIP is a harder benefit to claim than DLA was and so some people have been shocked when they haven't been awarded what they were expecting. I'm not saying any of this to worry you - simply stating the system. If your son's health hasn't changed, I would just wait to hear from them. If, however, his health has worsened and you believe he would get a higher award with PIP, you can contact the DWP and ask for a change of circumstances, in which case they will probably tell you to apply for PIP.

I believe (but realise it’s not a given!!) that he would actually be better off on PIP (probably Enhanced for DL and STD for Mob - though if they apply the descriptors properly he should get ENH in this too!) but there’s always that risk! He has a life long condition and things are unlikely to change, but know that indefinite awards don’t really exist in PIP.
I’m just worried that PIP payments/co dictions may be ‘less favourable’ in the future but existing claimants may be protected.
