Good morning,

Back in July I had my PIP withdrawn after scoring 0 across the board at my review. I have done a MR and their decision has not changed but I was awarded 2 points on one activity.

My health has declined a lot since my review forms were sent back in June 2024. So I’m unsure whether it would be more suitable for me to go to Tribunal or put in a new claim including the more recent issues I’m dealing with? Would a tribunal take new developments into account or can they only decide off the original forms?

Hi Charlotte

If your condition has deteriorated from when you had an assessment, the Tribunal will disregard the change in your condition, they will only assess you as you were when you were assessed.

We cannot advise you what to do, as we do not know what you were like when you had your original assessment.

You need to seek specialist advice from your local Welfare Rights Organisation: advicelocal.uk where they can take all your circumstances into consideration when giving you advice.
