I apologise for this long post and thank you for reading.

Please can I have some advice on exactly how to deal with this. I believe I have followed the correct channels to have everything looked at again but I feel like my information has been completely disregarded and a decision made without a fair review.

Here is the history, for tax year 2024/2025:

I received carers allowance throughout the tax year, but no other paid income except for a 15 week period (Sep - Dec 2024). My average wage was £131 pw during this period. And again, this was my only income throughout the whole tax year.

18 March, I received a notice of Compliance Telephone Interview for 24 March 25. I attended this telephone interview. It transpired DWP believed I had earned above the £151 per week that I was allowed. I sincerely believe this was incorrect.

I then received a follow up letter dated 25th March asking me to send information by 8th April.

I replied by letter on 31 March enclosing all the evidence. Below is a paragraph from the letter.

"I confirm I started my paid work on 2nd September 2024 and left on 12th December 2024 (as evidenced by Employee Record Card and P45. I also enclose my 4 payslips cover the 15 weeks I was employed. My P45 evidences my gross income for the 15 week period, totalling £1990.24 (averaging £132.68 per week, fully inclusive of holiday pay and, below the £151 per week I would have been permitted to earn). I can confirm this is the only paid work I have done throughout the tax year 2024/2025.

Please note payslip for week 28, covered a 5 week period.
Payslip for week 32, 4 weeks included £30.60 payment for mileage for errands.
Payslip for week 36, included £133 for the previous accrued 9 weeks holiday pay"

For background info, I actually left the job because I was only contracted for 2 hours per week, but the lady was constantly let down by other carers and was putting me under pressure to assist her more.

After sending the above information, I heard no more till a letter arrived dated 2nd July, informing me I was not entitled to C/A from 2/12/24 to 29/12/24 because 'my earnings wereover the CA limit for this period. And a further letter dated 3 July advising me I had been overpaid by £327.60.

I telephoned on 14/7/2025 stating I disagreed and could my paperwork supplied earlier be looked at again. Initially the handler said she could not see my letter and evidence. She finally located the evidence and said she would send it to the 'back office' to have it looked at again.

I have heard absolutely nothing until today when a letter arrives today advising me that £327.60 is going to be deducted from my benefit to pay this money back without any explaination or acknowlegement that my previous information had actually been looked at.

There has been no proper review. Apparently I can telephone a number and ask for a different repayment plan.

This dosent seem Just. I have pointed out their error but it has not been acknowledged, nor has it been explained to me if I have made error. My only paid income over a 12 months for a 15 week period equated to £132.68 pw.

Can I appeal this again? Can I insist on a tribunal? I honestly feel this is unfair and boils down to theft as my supplied evidence, clearly has been disregarded.

Hi Sooty1994

Your question is outside the remit of the forum.

You can appeal against the decision, we would advise you to seek help from your MP as Carers Allowance is a bit of a hot topic at this moment in time, or contact your local Welfare Rights Specialist; you can find your local Welfare Rights Organisation to help you with advice by clicking on the link below and putting in your post code, it will then come up with a MAP with a list of agencies in your area advicelocal.uk
