1. Does one's UC with LCWRA stop if you live with a girlfriend on a spousal visa? She can't work until after marriage so would one's UC stop during the months living together on that visa, before marriage?
2. Once you got married, if the now wife was unemployed/couldn't find work, what happens to one's UC with LCWRA since the now wife cannot claim benefits as she has no recourse to public funds?
3. I think I'm right in saying as soon as the wife finds work, then the UC with LCWRA would stop?
I can't seem to find this information anywhere so any pointers would be gratefully received.
As far as question 1 is concerned the claimant would not get extra UC for the person with NRPF. You would need to get specialist immigration advice as getting the girlfriend detailed in a Benefits claim may infringe her visa. There are also different rules for various Benefits and Council Tax. As for questions 2 and 3 you are asking the wrong questions. It is the Habitual Residency Test which comes into play and about which I am not qualified to comment, and on the subject of which you will find enough reading and case law online to keep you occupied until Xmas.
