Hi, my PIP reviews have been inconsistent (as I mentioned earlier) going back years, even though the information given about the progressive illness I have has been consistent, explaining how my daily life is affected.

I had a paper review so no medical needed which is good but it looks to me they've just copied my last reviews scores and they've written the sames reason for the scores too.

Totally ignoring what was written in the review form/paperwork.

Marking me down again from what I used to be on even though I have a progressive illness, that is getting worse--and they've been told it's getting worse.

I'm scoring less in one area than I used to and I have an illness that gets worse with age.

This surely will not make sense to anyone who looks at all my reviews as it's impossible I can be getting better and not struggloing more now than I was over 10 years ago.

So I have two questions:

1. If I get in touch with DWP explaining how I've been underscored in three areas where what I've written in the paperworks been ignored, will I have to have a medical, or might I have to go to a tribunal? Or, is it likely it could be put right without either.

2. If I do get upgraded...is it possible I could get back pay from the review they took it off me?

As I said in my earlier post the reviewers have taken one away when they've added the other and vice versa.

Having had it all looked at now as I was unaware...it seems a reviewers have underscored me by not putting what was in my paperwork.

Even though years before I was getting the scores and the higher grades in both.

Okay - when I replied to your last post, I didn't know that the last report was paper-based. If I've understood correctly what you wrote in your previous post - you never challenged the decision - so it is not easy to know why certain decisions were taken.

I'm not sure when you had your last review. You can challenge the decision up to 13 months after you received the last decision letter. You would put in a late Mandatory Reconsideration. You have to give a reason why you didn't put one in before, and then the DWP decide whether they will consider it. They have the right to refuse. If they are happy for you to put in for a mandatory reconsideration, they will look at any information you give them and make a decision. How far they backdate it will probably be at the discretion of the assessor, especially if it is a late Mandatory Reconsideration. If you can submit a timely Mandatory Reconsideration, i.e., within one month of the date on the decision letter, then they will backdate it to the time you submitted your review form.

If it was longer than 13 months ago, there is nothing you can do but put in for a change of circumstances. If you put in a change of circumstances and say that your health has worsened, it will automatically trigger a review, and you will be sent a review form. This will be your opportunity to fight for mobility and daily care. If you put in for a change of circumstances and you eventually receive an improved award, they will backdate it to the date on your letter informing them of the change.

If you go through the Mandatory Reconsideration process and lose, you will still have the opportunity to put in an Appeal. Mandatory Reconsiderations are not easy to win, and only 27% of people currently win them. However, over 60% of people win their Appeals. You can find more information in the Guide To Appeals
