The new UC LCWRA rules was created by Lulu3376
My son was awarded LCWRA last year with severe conditions criteria met and no further assessments required. As he’s still in education and is on my UC he’s not due to make his own UC claim until August.

As his LCWRA award states severe conditions criteria met, descriptors will always be met so no further assessments required - will he qualify for the old rate?

Would he his LCWRA have to be re-assessed due to the changes?

Hi Lulu3376

When he starts his new UC claim he will commence what the DWP call the Health Journey again but from what you have told me he should be placed in the LCWRA group because of the Severe Conditions rules as per below:-

"New claimants can also receive the protected higher payment of the health element if they meet new severe conditions criteria. To meet the severe conditions criteria you must both:

Have a life-long condition that a practitioner acting on behalf of the NHS has diagnosed.
Be assessed as “constantly” meeting at least one of the LCWRA descriptors used in the work capability assessment. "
