Hi

I've just taken on the role of appointee, for clmt whose been waiting for review decision since March 25.

I called PIP to ask if DWP could send me copies of the evidence already submitted as part of the review. the clmt couldn't remember. Agent said they couldnt send me anything but confirmed what was on file.

The original review submission doesn't accurately reflect clmts daily living struggles. For context under preparing food his submission states '
I have uncontrolled / unpredictable epilepsy..... at all times of cooking/preparing food it is unsafe and very uncomfortable/scary, I can have a seizure at any time. I use a microwave for my food
preparation and kitchen top covered small grill.
I use the microwave everyday and a small covered grill twice/three times a week. I am not
able to use any gas or open heat or flame cooking appliance, this is very dangerous for me,
I have burnt my forearm in the past due to having a seizure.
I am not able to use cutting items due to the high risk of cutting / injuring myself. I do not
use tinned food, due to the danger/unsafe sharp edges which can cut my fingers, hands
and face when falling down due to a seizure. '

This is correct , but fails to mention that he follows a clinically prescribed diet . This is very tightly controlled and restricted to keep him in a clinical state of ketosis . food is weighed , measured and specified to minute degrees. His blood is test x2-4 a day to ensure right levels. He doesn't deviate from this. he doesnt eat a varied diet bec of the prescription and bec he doesn't have skills and knowledge to maintain the therapeutic outcome of the diet without written guidance. his neurodivergence also limit his food tolerance and variety.[/i]

My question is , shall i add all this info in a further response to the AR1 to supplement what was originally stated ? i am sure there will be more gaps to fill in the original submission. i only mention activity 1 as an example.
I've asked 3 of his consultants to write supporting letters too. They were very surprised to learn he did not receive PIP.

Hi Sum

I would add anything that shows his difficulties, including the specialised dietary requirements. That's stressful to follow such a diet.

Hi

I was planning to send the claimants latest neurology consultation letter as further evidence. This would be in addition to the consultants PIP support letter.

I am hesitant because the Dr wrote in the consultation letter ...

As he is applying for PIP, [Appointee ]was going to let me know what information they required to accompany his application and I will write a letter.

I am worried how the DM will interpret this stm. Perhaps thinking we directed them in their support letter. Should i worry ? Can i redact that stm before sending ?

Hi Sum

It's certainly not helpful. If the consultation letter isn't vital, don't send. If you need the letter as evidence, then redact that paragraph. You can absolutely guarantee they will misinterpret it.

Just recvd a PIP review decision letter for his claim

Basically the decision is still pending !!! So they have extended the award to July 2027 - 1yr with the caveat to extend again if review is not completed by 2027.

the letter is timely bec i've been trying to collate evidence but struggling tbh bec brain cells are fried by the heat.🥵
I've book GP appts for him to get his records and care up to date. I attending with him yesterday and spent time with the GP talking about PIP supporting letter. (Cost of £50)

Might not need it bec of the consultation letters but still felt it was worthwhile having the chat and getting the GP to understand her patients real life struggles beyond the clinical paperwork.

Am i right that if the review results in a change in the award it will be backdated to the date of the review date ? Can i then challenge it and get the whole award looked at again ?

Another thought was to include the DLA info if i can find it . What do you think ?

Hi Sum

Backdated payments often depend on the decision-maker, and it can vary depending on when they agree a person's condition started. So, generally I would say that it should be backdated to the review, but it's not absolute..

I'm lost where you are with this claim, so in principle you should be able to challenge the entire award, but I can't caetegorically say yes.

Not sure why you need to include DLA information.
