Why don't the DWP have deadlines like claimants?

Just very frustrated at the system.

I have applied for DLA for my son, which was refused. Did an MR which was also refused. Now I'm waiting for a tribunal. Why is it that I have 4 weeks to respond to their refusal, but the DWP can take their merry time just giving me a date for tribunal?
I'm aware that it can take months or even years... I know the system is designed to make people give up. But honestly, why is there no accountability from their end??
As an aside, I don't even know why we bother sending in evidence when it is quite clear that they don't bother reading it- my report clearly states that my son is unable to walk for longer than 2 minutes without it causing him terrible pain- and yet they just refused.

Hi chk180182

I wish I could give you a satisfactory answer - but you know I can't. Personally, I don't believe the system is deliberately designed to make people give up, but I know there are plenty of people who would disagree with me. I think it is a poorly designed system with more claimants accessing it than they ever planned for, and not enough people to manage it. I agree with you that the open-ended system of us being held to timescales and the DWP taking as long as they wish is fundamentally unfair.

I also understand your frustration at them appearing not to read the evidence you sent in. I think one of the problems is that it's impossible to know whether they didn't read it, or didn't agree with it, or didn't believe it.

I'm sorry that you now have to go to Tribunal. It's not the DWP who will send you the date. Once you apply it is the Tribunal Service that will send out a date, and how long this will take depends on their workload in the area you live. Across the country, it is taking on average 52 weeks, but recently I have heard quite a few people who have waited approximately 30 weeks. Once you have applied, you can always ask the service in your area how long you are likely to have to wait.
