Successful change from 5 year award to ongoing was created by Anne
Our 35 year old son has haemophilia and is on the spectrum and was awarded PIP 10 years ago so his award was up for its first review. We received a light touch review form to complete and although his condition has not and will not improve we did think we should add some comments about new medication, increased isolation and general mental health downturn over the last 10 years, as to tick "no change" to some of the boxes did not seem correct. We wished we hadn't done that when we got the decision - the amount of the award had not changed (was not expecting it to) but the length had been changed from ongoing to 5 year review. The decision maker said this was because we had indicated there had been a change in his condition. We called DWP and spoke to a sympathetic adviser called Lee who listened and said that we could put in for a mandatory reconsideration of the length of the award. I was under the impression that the whole claim would be re-assessed if we went down that road but Lee assured us that was not the case. He forwarded our claim for reconsideration, putting our case forward, saying we felt we had been unfairly penalised for telling the truth about minor changes to our son's condition. About 4 weeks later we received a call from a lady who said she was going to be looking at the decision and wanted to confirm that it was only the length of the award we wanted her to look at. We explained why we ticked there had been changes to his condition but wish we hadn't. She asked our son some questions about what his day to day life is like, whether he goes out, his mental health etc. She seemed to take on board what we said and said she would do her best to get the award changed to ongoing. Finally got a letter yesterday and we are overjoyed that it has now been changed to ongoing with a light touch review in 10 years. I would just like to say to anyone filling out the light touch review form that my advice would be not to tick there has been any change unless your condition has deteriorated and you are looking to try and get your award increased. For any future review we will be ticking no change but putting any relevant comments we think necessary underneath.
