PIP denied

PIP denied was created by chk180182
My application for PIP was just denied.
I scored 6 points for care and 4 points for mobility.
The assessor was really nice on the phone but then seemed to blatantly lie in the assessment.
For example one of my issues is urge incontinence and the need to be near a toilet all the time. During the 1 hour phone assessment I needed to use the toilet 3 times, yet they wrote that I don't have any extra toileting needs, for example- and there are many other such examples.
I would like to fight this as I don't really have anything to lose. The problem is that I found this extremely draining. It took me over a year to summon up the courage to apply for PIP in the first place. My GP charged me £50 to put together my health record and write a letter, yet they wrote that according to my GP I have no extra needs...
I'm confused about what is going on here and what to do next.
Any advice greatly appreciated.

Thank you!

Hi chk180182

I'm sorry this has happened to you. I'm afraid you are not the first person to think they had a nice assessor and then find that the report does not accurately reflect what you reported.

First thing is to get hold of the assessor's report - if you haven't already got it. It's called a PA4, and if you phone the DWP, they will send it out to you. The PA4 will provide more details about how the decision was made than what appears in your decision letter.

You have one month from the date on the decision letter to submit a Mandatory Reconsideration and challenge the decision. You can find details on how to do this in the Guide to PIP Appeals (which also includes the MR information). If you can't meet the deadline, you can ask permission to submit a late mandatory reconsideration. If you need to do a late one, you have 13 months from the date on the decision letter, but you will have to explain why it is late.

I assume you didn't ask for the assessment to be recorded or record it yourself?

Your aim is to contradict what they have said and show them what you think they should have scored and point them to the evidence. You can say they are 'mistaken'... they have 'misunderstood' - they have 'omitted' or any other suitable word, but don't be tempted to say the assessor is a liar - however tempting or true that may be.
