TOPIC: Appeal looming - leter today

Re:Appeal looming - later today 8 years 7 months ago #28188

:woohoo: I won my appeal and am in the support group - Still in shock!

Thank you all for your kind words and support - it is really invaluable. Well was dreading it but the judge and doctor were very apologetic about having to ask such intimate questions about incontinence - but I told it like it is and the truth was enough!

We were arguing the toss about the definition of having no continence and the judge very politely asked my husband and I to leave the room while he and the doctor conferred, and then after the longest 10-15 mins of my life they called me back in and said that they had found a better clause to get me into support group that they felt stood legal and medical challenging - if DWP try that.

9 months of my life (since decision made) have been poisoned by this blooming system and what it does to you in that time.

Anyway am so grateful for your Appeals booklet as my husband and I did exactly as you advised and finally have one positive resul out of a catalogue of errors and mistakes by Atos and DWP/ESA.

HUGE HUGE THANKS TO YOU! x

Hi Louise

That is absoloutly fantastic :woohoo: well done!!! I found my medical report from Atos a couple of days ago and was gobsmacked to say the least when he answered the incontinance question!!! The Atos dr had put no obvious signs of incontinance!!!! Good god, what do they want!! I thought you would get it on that as it was the incontinance that had dwp overturn the decision just before tribunal. Is is an indefunate award? I am so pleased for you well done!!

Mm :) a smile costs nothing

Hi Louise,

Congratulations on getting into the support group and on your courage in going to appeal. There's always an element of risk in challenging a decision when you have got an award and I know many people decide it's too stressful to attempt.

Good luck,

Steve

Congratulations Louise,
it,s disgusting that You had to go through the stress and worry of on appeal due to the incompetence
of yet another A.T.O.S doctor ( so called )
but at least common sense has prevailed and they finally arrived at the right decision. Another one in the eye for A.T.O..S.

Best Wishes.

Bill
