Short review dates was created by Catherine
Can someone please confirm if being given a short review date following a PCA or WCA when previously IB exempt for a longer period is something that can be appealed against or is it an inappropriate action because your actual benefit is unaffected?
Thanks
Thanks

You cannot appeal a WCA review date or previously a PCA review date, because this date is what is known as a 'determination' and as such does not form part of the entitlement decision.

Thanks Crazydiamond.
What can be done about a situation where someone clearly has long term conditions and such a determination is likely to cause a great deal of distress?

Probably the most effective would be a complaint to the DWP, copying in your MP, however, a prerequisite of this would be your being able to show repeated, unreasonably early re-assessments and medical evidence that these assessments have had a negative impact on your health.

Your options are somewhat limited. There is no legislation or case law that stipulates how often a re-assessment is reasonable. Thanks Crazydiamond.

as crazy D has said complain to get information on what is a decent date is hard as drs and DM would all have differnt ideas
best place to start is the a to z of medical conditions as it gives plenty of information on differnt health problems and prognosis too this is aimed at dla but could be used as a rough guide IMO
