I was thinking more of a Tribunal using an incorrect medical report. Just imagine the scenario where one of those bad reports is used to decline ESA which is subsequently appealed and allowed and a DM then using the same report to discredit a DLA claim. You could then be going to another Tribunal with all sorts of legal arguments, a horrendous situation. Surely if the two benefits are seperate then a Tribunal should not be legally allowed to use such a report.

I agree with you! From reports what appears to happen is an adverse ESA report is used (mainly) by a DLA panel doctor to discredit a DLA appellant. Its time it was tested!

Hi I had a tribual in 2000, it was a nerve wracking expereince, just be yourself and take someone with you, I had my cpn and my mother with me. It was difficult but the tribual panel were understanding and sympathetic. I wish you lots of luck, go for it. JUst show where you need help from someone and see what happens. Good luck.
