Hi i wrote on here yesterday about my dla care being reduced It states in letter to appeal within 1 mth but i rang dla up day i got letter and the fella said he would put it through for reconsideration taking about 11wks and then if not in my favour i could appeal but should i get letter about reconsideration and technically i would be out of time for appealing as i don't have anything in writing as proof sorry this sounds a bit muddly what should i do :unsure: any help greatly appreciated

Our standard advice to claimants is to appeal rather than ask for a Reconsideration.

Our reasons for this are that if you ask for an appeal, the DWP are required to carry out a a Reconsideration anyway.

If ask ask for a Reconsideration only, and the DWP do not find in your favour and you subsequently appeal, they still have to carry out another Reconsideration, adding weeks, if not longer to the process.

You can always withdraw and appeal at any stage prior to the hearing.

As always, the decision is yours to make.

Hi MM,

It would be advisable to send a letter, within the 1 month deadline, or indeed a GL24 appeals form, in which case a reconsideration would automatically be carried out anyway.

It can be fatal to a claim or appeal, to simply rely on information given over the phone, for the reasons that you rightly state.

You should always keep a copy of either of the above, and post by recorded delivery.

Hi Gordon + Bro58 just to let you know i've received confirmation by letter from dla of my communication on the 13th jan to dla by telephone to disagree with their decision however i have just downloaded GL24 so will be completing that as well THANKS AGAIN
