Dla appeal and new claim turned down.

I lost my job due to ill health as I have Me/Cfs,Fibromyalgia and Trigeminal Neuralgia.I worked for the same financial company for 27years and applied for an ill health early retirement pension which I was successful in receiving.I was advised by my job centre "consultant" to apply for Dla which I did and received Hrm and Mrc for 12months. On renewal I was turned down so asked for the decision to be reconsidered. A doctor was sent out and spent nearly 2hrs in my home asking the questions from his Dwp medical form. Dla was turned down again so I asked to go to a tribunal. On receiving a copy of the doctors completed form back there were errors far too numerous to list here. On going to the tribunal my husband came with me to be my representative due to my condition. On arriving at the appeal we were told by the clerk that the papers had only been received and given to the tribunal that morning and they were "looking at them now" I was asked if I would like to rebook the appointment but as I had waited 8mnths and felt that I had a good chance of winning I turned down this offer. The Tribunal was AWFUL!! they would not allow my husband to speak as they said he may "coach me in my answers" After 40mins of being grilled by the dr I was advised straight away that my appeal was unsuccessful! Since then I have tried to claim again and been turned down. I have spoken to a Welfare Rights Officer who has said that I will never receive DLA again as the Dwp will look at the tribunal notes and I have alsdo been told this by a Welfare Rights Solicitor. I would also like to point out that I have used this site every step of the way when filling in forms,preparing for medicals and tribunals as I have been a member for 3years. Should I continue to apply for Dla or just accept that this is a lost cause!!

Hi E,

There is nothing to stop you reapplying for DLA.

Each fresh claim is supposed to be taken on it's individual merit.

Some members have reported having to claim 5 or 6 times, before receiving an award.

The important thing to remember, is to go into detail regarding your limitations/disabilities/care needs, as a result of your medical conditions, rather than the medical conditions themselves, although the medical conditions are obviously relevant.

Did you enlist the support of your G.P.? , have you made him aware of your limitations/care needs?
