Hi my name is Wendy,I currently receive DLA, Incapacity Benefit. I also receive Income Support as I have brought up my granddaughter since birth,as her mother did not want her,I am ashamed to say her mother is my daughter.[removed] is now 12yrs old and a beautiful young girl,unfortunately it has happened again,her brother [removed] aged 4yrs is now with me removed by social services for neglect. I could not see him go in care so he is with us. Will I be penalised for this, by DLA etc.I have early onset of Emphysema, Epilepsy and various other ailments will they think me well enough now to work,I do get a lot of help from family etc.but with whats been tv, Iam worried sick. Please,please could someone help.

Just so you are aware I have removed the childrens names from your post, I would strongly recommend you do not post here or elsewhere on the internet.

I am afraid you need to get face to face advice from your local CAB or Welfare Rights office. This situation is extremely complicated and potentially has legal implications with regard to the guardianship of the children, all of which is beyond our remit to help with.

Why can’t you answer a question about my specific claim?

With regard to your benefits, there are two issues at hand; first, are you entitled to further benefits as a result of your caring for these children, and secondly, does your caring for these children have implications regarding your DLA, specifically, will it be seen as being at odds with your own care and mobility needs.

Thankyou Danny, yes at the moment my solicitor and myself are going for a residence order. It`s just the benefits I worry about, knowing they are in the spotlight so much. Obviously if thigs get too muchthen things will have to changed.I just didn`t want him in a few years wondering why the other two were kept and not him,as the eldest child lives with my daughter.I am worried about the DSS coming down on me.I know people have taken on their grand children who are in worse situations than me,I just know what they will do.
