can I ask if you're ESA is due to be removed after the12 months time limit and your condition has deteriorated since the original claim can you reapply under a change of circumstances with the hope of replacing the support group.

If your condition has deteriorated and you now believe you meet one or more of the Support Group criteria, then you can ask for a SupperSession on your current award.

This can be done even if your ESA has ceased providing you have maintained Limited Capability for Work during the interim, although the mechanism, in this specific case, for doing this is not currently clear.

As has been previously pointed out how someone satisfies the condition that a person has maintained their Limited Capability for Work status has not been defined w.r.t. Example 7. Hopefully as the situation deteriorates into utter shambles someone at the DWP will come up with an explanation or perhaps an MP could get the necessary information.

Surely, once you have Limited Capabilty for Work status it lasts until you have a medical which decides you no longer have it?

Also, I have a related point; once your 365 days has finished, can you still claim NI credits?

The DWP have not yet released details of how they intend to implement this. I suspect that 'common sense' will play no part in this!

I think that one will still be able to claim NI credits but, to do so, will still have to submit to regular reassessment.
