Hi

My sister has had her appeal tribunal adjourned as she was unable to attend her appeal to move from ESA WRAG to the Support Group although she had a representative go on her behalf with a background in Welfare Rights. Her condition is agoraphobia. As I also suffer with this I know just how incapacitating this is. She had someone representing her, but the appeal tribunal said they wanted to see her and that they could arrange a domiciliary tribunal in her town. They also want her medical records and her DWP records and for her rep to highlight the key points from her ESA50. She submitted a very detailed ESA50 and had her GP letters backing her up and also her representative could find 3 of the descriptors she satisfied for her to go in the Support Group and if not these then Reg 35 which states if health would be dversely affected by not being in Support Group and her doctor has clearly backed this up. She is now thinking of withdrawing the appeal because she doesn't want to go threw all that stress again (and I felt nearly as stressed by it too). She's not been hassled (yet) in the WRAG and they have given her two years in it. Any advice? Would she be better off withdrawing her appeal?

Why can’t you answer a question about my specific claim?

You don't say whether your sister is receiving ESA(CB) or ESA(IR), but if the former, then she should consider the following;

12 Month Limit for ESA(CB) – Including Amendments
