Hi Gordon,
I still have,nt had written conformation of my result, i was expecting it in the post today, it will be a week on Monday since the phone call, the one i missed so i,m assuming that was the decision date, so by the time i get the letter from DWP i,m already 1 week less of my months appeal, is it ok for me to download a GL24 and send it in stating my reasons for appeal even before i get written proof of failed medical from DM.

I would certainly get the GL24 completed, however, you need the date of the Decision letter to complete the form as it is used as the Effective Date of the Decision, if this is not correct, then you risk the GL24 being returned as incomplete.
Don't be afraid to chase the DWP for an update.

Thank you Gordon, if it does,nt come in tomorrows post i will ring them up, as the quicker i send in the appeal and fit note, there may not be such a break without me receiving assessment rate ESA, sadly i can,t live on fresh air, i have bills to pay.

I recieved the paperwork today, apparently i was given 6 points for mobilising because i walked 20 metres very slowly into the examination room but the HCP or DM because i,m confused now, whichever one of them has decided i could not mobilise anymore than 200 metres, but my scoresheet still says zero points, also it states i said i sit for an hour in the mornings when i get up (i did,nt say that), also it states i can stand or sit or both for more than an hour, as my assessment lasted 40 minutes and i did,nt sit the whole 40 minutes, also that i could use two steps, even though it states i had assistance with the one step used to get on the couch, and thats just a few discrepencies

A couple of things for you.
If you believe that the medical report is not reflective of the discussion you had at the assessment you can make a complaint to ATOS Healthcare, see
Complaining to ATOS Healthcare
You need to distinguish fact from conjecture; as an example; if the ATOS "doctor" says that you sat during the assessment for an hour, then this is a fact, if they state they believe you could sit for an hour based on what they saw, then this is conjecture.
Most ATOS medical reports contain conjecture, based on the statements you made in answer to the questions during the assessment, only the really bad ones, contain disputable facts.

A lot of the things are conjecture, i don,t think my nerves can stand much more , i,m just going to appeal, this whole thing has made my anxiety and depression so much worse, even that was commented on, apparently my mental state is ok because i only see my GP about it and not a specialist, also i think they must expect people to scream and shout, the only comment was i appeared tense.
