Hi to all Mods,
another update, i finally got through to dwp after seems like hours of trying, a lady said that i had been rung 3 times yesterday which is totally untrue, she was very nice and at that point i broke down, she told me that a note had been put on my file for urgent assessment rate of esa, i told her that i was going to complain about how i have been treated and she said do it in writing and involve my MP which i have done i rang his office and spoke to someone, and he told me to email him the details and that he would put in a complaint, just something else i think that member should know i went to pick up my crisis payment from my local jcp, and needed to use the loo, was told that i could,nt, so if those that go for their wfi maybe they should be aware of this if they have problems with bladder? bowls etc, just another way of making disabled people feel like dirt.

Hi,
As the Job Centre Plus, ( and ATOS ) are both public service providers, they must comply with legislation under The Disability Discrimination Act, mainly superseded by The Equality Act 2010.
In that, they must make "Reasonable Adjustments" for people who are classed as disabled with respect to the DDA/EA 2010.
This could mean being classed as disabled due to bladder and bowel problems, or any other medical condition.
See :
www.direct.gov.uk/en/DisabledPeople/Righ...ligations/DG_4019061
www.direct.gov.uk/en/DisabledPeople/Righ...ityRights/DG_4001068
odi.dwp.gov.uk/disabled-people-and-legis...010-and-dda-1995.php
See also 20, 21 and 22 regarding "Reasonable Adjustments", from here :
www.legislation.gov.uk/ukpga/2010/15/contents
It is up to the individual to inform the DWP or ATOS as early as possible in the proceedings if they are classed as disabled and will therefore require "Reasonable Adjustments".
This may include access to toilets if they suffer with bladder or bowel problems.
With respect to this problem in particular, the information from this link may be useful also :

I hope the above is helpful to members.

Hi bro58,
I,m glad i brought this to your attention, as i think being able to use toilet facilities is a basic human right, i was quite shocked when i was told to go across the road and use the council offices toilet.
But it was worth a mention on the forum for people having to attend WFI,s that they need to address this policy if they do have problems with bladder/bowel to the JCP office that they will have to attend, i had heard before today that this happens at my JCP Office, i don,t know if its the same countrywide, the mind boggles.

Yes CV,
A bit off the original topic of your appeal I know, but a good opportunity to inform members of their rights under the law.
The DWP/ATOS should be well aware of DDA/EA 2010 legislation, it is up to the individual to ensure that they comply, unfortunately.
