DLA - renewal or supersession? was created by happyturtle
I am currently receiving DLA low rate care and high rate mobility. My renewal pack just came in and is due in November. I am hoping to be able to move up to middle rate care. It has been a very gradual deterioration over time, but in addition, I have better evidence now than I did then.
Will the renewal be enough for this? Or do I need to do a supercession to say my condition has worsened?
If I do the supercession, do I also need to do the renewal at the same time in case the supercession is denied?
Cheers,
Hope Ann

As your medical condition has deteriorated, you should seek a supersession of your subsisting entitlement now and not wait until the renewal in November.
If you wait until the November date, you will lose out on any revised award you may gain as a result of the change in your care needs, and as such you would forfeit any arrears to which you may be entitled. However, there is an important caveat of which you should be aware and in this respect you should see:-
Is there any risk to challenging a decision?
In the third paragraph of the FAQ the word "challenge" should be substituted for "request a supersession of" the decision.
If the supersession is successful there it is likely that the award may extend beyond the November renewal date, and consequently this date will become irrelevant.

Hi Hope Ann,
to my knowledge you just need to fill in your renewal stating your condition and if DWP think you are entitled to a higher rate they will award it to you.
At renewals in the past I have gone from HRM only, to HRM and LRC. At the last renewal even though the DWP decided to take both my awards away and I had to appeal the Tribunal then awarded me HRM and MRC. So over the years my award has increased without ever asking for a supersession. I hope this is of help to you.
