QUESTION RE NEWAND OLD APPEALS was created by Athena
I have had my medical re transferring from IB to ESA and awaiting to hear the decision. I am completing my Appeal (just in case, in order for me to get it posted off asap)and I was wondering whether it is a good idea or not to photocopy and quote an old IB appeal which was successful as my condition has not improved since then.
I would welcome any feedback.

You are entitled to submit whatever evidence you feel is appropriate to your appeal.

However, you should consider is the relevance of the evidence to the ESA descriptors. There is an IB Transfer guide in Members area that compares the old IB decscriptors to the ESA ones, it might be helpful for you to have a look at this, see

By all means include it if you think it contains anything helpful. However don't forget that the criteria for IB are vey dfferent from the ESA descriptors. Your evidence will carry more weight if it directly references the ESA descriptors that apply to you.

If this does go to appeal, send this eveidence in straight away as it could increase your chances of the decision being overturned at the reconsideration stage. Incidentally, if you have anything like this that you think might help, it is a good idea to include it with the ESA50 as it gives a better chance of the decision going in your favour in the first place.

Thankyou. The completion of the form was very rushed and distressing as a close family member had died 2 days before and I needed to get the form back in good time to meet the deadline. I did state on the form my circumstances and that I felt I had not completed the form as I would have hoped, but I don't think they really took any notice of that.
The Doctor at the assessment stated that he did not feel I would have any problems with my claim however, I am still not confident as my last medical assessment the Doc said pretty much the same but she stated a load of incorrect answers on my assessment, in fact it was so bad that I actually thought they had sent me anothers by mistake!!!!!

Hi Athena

Although it's too late now, I would point out that there is nothing preventing a claimant from sending additional information to Medical Services after the ESA50 has been sent. Any further information you send to MS should be placed on your file and viewed by the healthcare professional conducting the assessment.

This will effectively allow you to complete the information that you would like to have place on the ESA50 but couldn't due to the deadline.
