Hi all
Could somebody help with a question, i've searched faqs and forum but found nothing. Here goes i attended tribunal hearing on 20 july, i received decision notice that disallowed appeal. I have sent a request for the statement of reasons and record of proceedings, this i have done solely due to the tribunal not asking any information about my illnesses. The medical member asked who wrote the letter she was holding and the letter was the main emphasis of the hearing, bit baffled to say the least. Anyway the decision notice explains that the tribunal decision can be suspended if it is being appealed, this is my intention. In the past i have still received benefit whilst appealing the tribunals decision. Is this how it would work?

Hi B,

You can only appeal a First Tier Tribunal decision to the Upper Tier, if there has been an error of law, see :

What is an Error of Law?

As far as I am aware, you would not receive any benefit, whilst appealing to the UT.

Firstly - you can only argue against the tribunal decision if there was an error of law, not because you don't agree with the decision. When you get the paperwork through,you should get expert advice to see if there was an error of law.

Secondly - when appealing to the Upper Tribunal, I believe that payment is notcontinued during this time.
