Advice please was created by buffy12
I sent my medical questionnaire back two weeks ago, I received a letter today saying that I have been placed in the Work Related group, it says if i'm not happy I can write and ask for the decision to be looked at again and for an explanation how they made their decision.
Would just writing a letter be okay and should I explain why I believe that I'm unable to return to work????
I'm completely confused any advice would be welcome
Many Thanks

First congratulations on being placed in the WRAG, it may not seem it but this is a success.

It's a common mistake that being placed in the WRAG means that you have to seek work, you do not, but you are required to participate in Work Related Actvity. See

Work Focussed Interviews

and

Work Programme

It is not enough to believe you should not be in the WRAG to ask for the Decision to be looked at, you need to show that you meet the requirements of the Support Group.

Qualifying for the Support Group

If you decide to appeal, then your options and the process are described in our ESA Appeals guide. See

www.benefitsandwork.co.uk/help-for-claimants/esa

You also need to be aware of the following

Is there any risk to challenging a decision?

How long do I have to appeal?

How to submit an appeal

12 Month Limit for ESA(CB)

Do I have to attend WFIs while I appeal?

If you have any furthger questions, please come back to the forum.

Thank You for the reply, I wouldn't have known how the fill the questionnaire in without this website :)

I really don't know what to do now, I'm worried if I ask for my form to be relooked at that I could lose my award.

I said on my form that I can only go out when accompanied by someone, I don't cook because I leave pans on,I have no idea how i havent burnt my house down . I have to arrange something weeks in advance to be able to cope with situations, I cannot be around new people and I've been known to get really angry in public due to my depression. I was waiting to be referred to a psychiatrist when I filled in my form and now after my appointment my medication has been changed and one has been doubled.

I'm now worried about what happens in a year when my benefit is stopped, and how this new process will work :(

The risk to your current award is real, but only a small percentage of claims are effected.

You can understand the risk better by requesting the documents used to to make the DEcision on your claim, inparticular the ESA85, if you had a medical, and the ESA85A, if you did not, will give you an understanding of how many points you scored. See

ESA medical – what forms to ask for?

Also, please have a look at the Qualifying for the Support Group link I posted yesterday. If you are unable to show you meet the criteria for the Support Group, then appealing may be an unnecessary risk.
