The ICO guidance for Freedom of Information requests is 20 working days, SARs are 40 calendar days.

The first thing to do is to confirm that the DWP have received the FoI request, and that they have not already responded, even though you have received nothing.

If they have failed to process a properly submitted request, then this would be a breach of the Freedom of Information act and you can make a complaint to the ICO.

Hi Gordon,

If the information requested if of a personal nature, would it not be a Subject Access Request under the Data Protection Act 1998 ?

This information is supposed to be produced/disclosed within 40 days.

FOI's are requests for information that is not personal to the individual.

Cheers. :)

Hi Bro58

There does seem to be some inter-changeability between the two, and certainly you often see claimants using an FoI request to retrieve personal information on other sites, but I agree with you that my first port of call for for retieving personal information from the DWP would be a Subject Access Request.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
