atos medical was created by Brian
had an atos medical on june 22nd .igot a letter on30th july from dwp telling me generally that as my wife works part time i would not be entitled to any money. i phoned the dwp and was told i have been put in the wrag group. ican agree with all this but surely i should have been informed that i have been put in the wrag. the whole system needs a good shake.this was my 3rd atos medical and the only one i was treated as a human being.

As a decision to award ESA in the WRAG (LCW) or ESA in the Support Group (LCWRA), or indeed a decision to find the claimant “fit for work” carries a right to appeal under s12 of the SSA 1998, see :

Decisions which carry a right to appeal under s12 shall be notified to the claimant in writing in accordance with Reg 28 of the Decisions and Appeals Regulations 1999. see :

Therefore, you should have been notified In Writing
