I have appealed that I should be in the Support Group not WRAG on migration from IB to ESA. One of the (several) points in my appeal submission was that I cannot repeatably and reliably walk more than 50 metres, therefore should be considered unable to walk more than 50 metres; the medical report, without any evidence, stated I could walk 100 metres once a week.
My DLA came up for renewal and I have been awarded LRC, as before, on the basis of the cooking test. I have not been awarded any Mobility, because I ‘can walk 100 metres’ – and the evidence they have used is my ESA medical.
On the one hand, I don’t think I’m entitled to Mobility component, because reliability and repeatability don’t seem to be criteria for DLA, and I can walk more than 50 metres if I choose the time; but on the other hand I’m really hacked off that they are using the ESA medical, which has different criteria, and which I dispute anyway.
I am also hacked off that they have only made the award for two years (last time it was three) – as ‘treatment may change how much help you need’ – my treatment hasn’t changed since my last application so I don’t know why it’s suddenly going to work now. (I know the length of the award isn’t appealable.) Since I’m fairly clearly not going to be entitled to PIP I think this is just a spiteful way of losing me a year’s benefit.
So I don’t know whether to appeal, because they’re using dodgy evidence, or to complain (and if so who to – I may be building up to another letter to my MP anyway, especially if my appeal to go in the Support Group fails).

You are certainly correct that being unable to repeatably and reliably able to complete one of the ESA physical activities means that the activity should be constrained to what you can do.
Picking up on the comment that you can walk 100m once a week, it would seem reasonable to me, given the "doctors" opinion, that this means that you cannot walk 100m 6 days a week, and therefore, for the majority of the time, you cannot walk 100m.
Remember the ESA test is for mobilising which includes your covering a similar distance in a wheelchair, irrelevant of your using or even owning a wheelchair.
The mobility test for DLA is in some ways far more complicated than the ESA one, as the Decision Maker must take account of your speed of walking, your gait, whether you need to stop, etc., so I would not assume that issues such as reliably and repeatably are excluded from the DLA assessment.
Unlike ESA, as the length of the award is part of the DLA Decision, it is also appealable, although it is rare to here of any appealing purely on this basis.
It is in princpiple possible to appeal just the mobility component of your DLA award, however, the Tribunal are not restricted from also looking at your Care component, although they should give you notice of this.
The decision you face, that whilst being moved to the Support Group on the basis of your mobility would be supportive of an HRM award for DLA (the ESA test is more strict), until such a Decision is made, you are disadvantaged in appealing the DLA award.
As awlays, please be aware that there is a risk to your existing award when asking for it to be looked at again.

I hadn’t twigged at all that the length of award was appealable with DLA, unlike ESA – should have read the guide more carefully and not just assumed!
But I don’t think it’s worth the hassle just to appeal on that; and I feel I’m on too shaky ground appealing the mobility component without having had a response to the ESA Support Group appeal (and by the time I get that it’ll be too late). I don’t think I can cope with the stress of two appeals.
I think I’ll probably work on a complaint to my MP.
Incidentally the DLA letter also said I prefer (but don’t need) someone with me for guidance and supervision outside – this is very odd because I said no such thing and neither did the ESA medical report.
