Just to warn you that the eligibility for income-related ESA depends on your partner's income as well as how many hours are worked.

Hello Hurty back,
Thankyou for your comment, yes i am aware that his income amount would be a factor aswell. he is a gardener on a faily low hourly rate.

Hello again,
well yesterday my partner came home from worked and confirmed that his hours are definately going to be reduced, his boss has however said he can do 3 days totalling 24 hours but he will be able to do less if it benefits us !! so now my query is , is it 24 hours or less or less than 24 hours and also does anybody know the maximum his wages would have to be to qualify for income based?
( trying to work out if we would be better off claiming the esa or just leaving it and see what happens)

Regulation 42 of the ESA Regulations 2008 defines it as

“remunerative work” means work in which the claimant’s partner is engaged or, where the partner’s hours of work fluctuate, the partner is engaged on average, for not less than 24 hours a week, being work for which payment is made or which is done in expectation of payment.

I take this to mean 24 hours or more.

The basic couples rate is £111.45, income should be taken as after tax, I'm not sure about other deductions such NI and company pension (if applicable). As a first port of call, there is a benefit calculator at the Turn2us website, but I would recommend you get a proper estimate from a trained advisor, see
