ADVICE NEEDED RE LATE APPEALS

Hi there

I was placed in WRAG last October 2011 but had a reassessment in June 2012 after I received a ESA50 and had medical at atos who said it may take some weeks before a decision came out.

After waiting for the decision to come for 10 weeks I decided that I should check when it was likely, only to be told I had been sent a decision 1 week after my medical!!!

I have not received this or any other correspondence from the DWP and because it is past the 28 days they said it may not be accepted for a late appeal for WRAG to support!!

I have apparently been kept in WRAG but I needed to be in support group as my condition has got alot worse since my first medical.

So how likely is it I can still appeal to go from WRAG to support past the 28day time period?

Has this happened to anyone else because I don't even think they sent me a letter out at all.

You can appeal up to 13 months after a decision if you can show good cause. Common sense would suggest that not getting the decision letter would be very good cause - but DWP do not always seem to be subject to common sense!

Thanks to all the mods for your quick responses and helpful info.

It would be interesting to know if this is a usual tactic applied to WRAG claimants!

extra question:

If I can't get an appointment with the Welfare Rights officer before I send off my GL24 do you think it's ok to put them down on the form as my representation or should I leave this blank until they have seen me?

You do not need to nominate a representative on the GL24, it can be done at a later date.
