DLA RENEWAL

In April I had an Atos medical for ESA although the doctor stated that I had significant walking and standing issues and also unlikely to return to work in the longer term (AGE 64,)I was placed in the wrag group,I made a request for an oral hearing appeal,I received a letter back from the dwp telling me I have been placed in the support group(did not need tribunal)I am now in the process of a renewal of dla higher rate mobility middle rate care,I am due to have more surgery in September I am sending back the dla claim form,should I send back a copy of the Atos medical,various errors,and incorrect info by doctor,or should I just send in dla renewal form on its own ?

Send in anything that might help. As DWP sometimes use recent ESA assessments for DLA renewal, it cannot hurt to point out any errors in the ESA paperwork, especially if you have any evidence to back this up.

If you believe that the ESA assessment report is supportive of your DLA claim then you should consider including it, the ESA mobility descriptor is stricter than the DLA equivalent.

Although the DWP refer to 'renewal claims', such claims are treated exactly the same as new claims, so as others have advised it's important to include anything that is relevant. If your mobility/care needs have worsened since your last claim or if you have a further medical condition(s) it's important to include these details as the DWP won't be aware of them unless you'd notified them previously.
