Hi guys, something's been niggling away at me and am wondering, because of the time relevance which you can gain, if i'm correct, when going for supersession...........am unsure as to when for what reasons you can ask for one?
My reasons for appealing included the fact that they completely seemed to ignore part 2 of esa50 - nil points, and were even sent letter from Consultant assuring them of written report to follow, which they totally ignored and because of which am still pending appeal from WRAG to SUPPORT.
Can't remember what I read to make me question the above, but any constructive comments appreciated.
You can request a Supersession on your claim, either ESA or DLA, when you believe as a result of a deterioration of your existing condition(s) or a new condition, that you would meet the criteria for a higher level of award.
As it is you the claimant, initiating the re-assessment, the burden of proof lies with, so you will need to provide significant new evidence, to support your request.
A Supersession differs from a appeal in as much as an appeal is concerned with your condition at the time of the Decision being appealed, whereas a SuperSession is concerned with you condition since that Decision.
