i got my bundle from DWP that also gets sent to the court ready for my case to be heard regards my eas.
I found they failed to send the court many peices of evidence including my medical evidence and my appeal letter stating all the reason i was appealing and the atos recording of the assessment
i have since had the letter from the court stating they have also recived the bundle and to sign the form and send it back, which i did with all the missing documents dwp failed to pass onto them.
Nothing surprises me anymore with dwp they will try anything so you dont win!

i can rest knowing now the court do indeed have all my evidence.

Hi,
Whilst technically speaking a Social Security Tribunal hearing is a Court of Law, it is a much more informal process with the Tribunal Panel Members sitting around a table, with the appellant and any representative, family member or friend/carer sitting at the other side.
Unlike a more formal Court of Law, a Tribunal can accept 'hearsay' evidence and their decision is made 'on the balance of probabilities' which in simple terms means ' more likely than not'
Tribunal Judges can direct that appellants give evidence on oath, although from my experience this power is rarely exercised.
A Tribunal is a complete rehearing of your claim, and Tribunal Members have wide powers on which evidence to accept and which to reject.
Case bundles are sent out by the Tribunals Service not the DWP, and your case bundle should contain all documents that are sent to all Tribunal panel members and to the DWP Decision Maker.
Hope this clarifies the situation.
Jim
