file sent back to dwp was created by karenwb9
Hello,
I was wondering if anyone else has had this happen to them.
My husband and I filled out my ESA50 questionnaire and posted it via recorded delivery along with a supporting letter from my doctor and occupational health worker as evidence.
We followed your advice to the letter, we didn't give our phone no. on the questionnaire and asked for everything ie, appointment in writing.
I had an appointment date back in the post, for 4th oct. of course as you can imagine I was so stressed up because its like these people are calling us and our support workers liars.
on the 20th sept. I received a letter from atos dated 19th sept. stating that my medical notes had been looked at and it wasn't necessary for me to have an assessment at this time and any appointments are to be cancelled and my file sent back to DWP.
I am not really sure what this means or what if any group I will be placed in.
any advice
many thanks

Nothing on this board constitutes legal advice - always consult a professional about specific problems

It is likely that the appointment for a face-to-face assessment had been sent before your ESA50 and accompanying evidence had been fully processed. DWP cannot refuse your claim for ESA without a face-to-face assessment, so this is a good sign. However, it is not possible to know what group you will be put into, I'm afraid you will have to await official notification of that

Hi cl,
As MHB says it looks like ATOS have decided that you have provided enough evidence for them to make a recommendation as to which award of ESA you are entitled, (WRAG or SG) this is classed as "paper scrutiny".
In this case, they will have generated an ESA85A Medical Report, which will also include the "prognosis" which is the recommended length of any ESA award.
These recommendations are then returned to The DWP Decision Maker, who will actually make the decision on the ESA award.
Once you have received notification of the decision you may wish to request the documentation used in coming to the decision.
See :
ESA Forms
ESA medical – what forms to ask for?
The positive aspect is, as MHB also states, that you can not be found "fit for work" unless you attend a "face to face" assessment.
Just to be on the safe side, I would keep the letter stating that you do not have to attend a "medical" in a safe place.
