If I am my son's appointee, can I go to the appeal on his behalf as he has mental problems and won't cope, or does he have to attend too please?

Hi,

If you are your son's appointee, you can attend an appeal on his behalf.

However, if at all possible, it would improve your son's chances of a successful appeal, as Tribunal Panels prefer to see the claimant in person, if at all possible.

Hi Jim thank you so much for replying, if I take him along though won't they start questioning him instead of me or as well as me, he wouldn't cope well with that, but he could sit there ok?

Sorry to be a nuisance but do you know if he would still get paid his benefits while appealing to put him in the support group please?

If your son was put into the WRAG, this money will continue until a new decision is made or 365 days has passed, whichever is the soonest. After 365 days in WRAG, the benefit will be means-tested, if it is not already.

Hi T,

Please see : What will I be paid while I appeal?

With respect to the above, if it was a "fit for work" decision being appealed, you would also have to provide a "fit note" Med 3 obtained from the G.P. to be paid assessment rate of ESA.
